HIPAA NOTICE OF PRIVACY PRACTICES

Your Information. Your Rights. Our Responsibilities.

This Notice describes how medical information about you may be used and disclosed and how you can obtain access to this information.

Please review it carefully.

This Notice applies to Protected Health Information ("PHI") maintained by Pharmedico Compounding Pharmacy & Wellness ("Pharmedico").

YOUR RIGHTS

When it comes to your health information, you have certain rights.

1. Get an Electronic or Paper Copy of Your Health Information

You may ask to see or obtain an electronic or paper copy of your prescription records and other health information we maintain about you.

We generally will provide a copy or summary of your health information within the time required by law.

We may charge a reasonable, cost-based fee when permitted by law.

2. Ask Us to Correct Your Health Information

You may ask us to correct health information about you that you believe is incorrect or incomplete.

We may deny your request in certain circumstances, but if we do, we will explain the reason in writing as required by law.

3. Request Confidential Communications

You may ask us to communicate with you in a particular way or at a particular location.

For example, you may ask us to:

Call a particular telephone number
Contact you by a particular method
Send correspondence to a different address

We will accommodate reasonable requests.

4. Ask Us to Limit What We Use or Disclose

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.

We generally are not required to agree to every restriction.

If we agree to a restriction, we will comply with it except as permitted or required by law, including when information may be necessary for emergency treatment.

Services Paid in Full

If you pay for a healthcare service or item completely out of pocket, you may ask us not to disclose information about that service or item to a health plan for payment or healthcare operations.

We will honor the request when required by law unless disclosure is otherwise required by law.

5. Receive an Accounting of Certain Disclosures

You may request a list, called an accounting of disclosures, identifying certain disclosures of your health information made during the six years before your request.

The accounting generally does not include disclosures for treatment, payment, healthcare operations, disclosures you specifically authorized, and certain other disclosures excluded by law.

We will provide one accounting during a 12-month period without charge. We may charge a reasonable, cost-based fee for additional requests within the same 12-month period.

6. Get a Copy of This Notice

You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.

We will provide a paper copy promptly.

7. Choose Someone to Act for You

If you have given someone medical power of attorney, if someone is your legal guardian, or if another person is legally authorized to act as your personal representative, that individual may exercise certain privacy rights on your behalf.

We will verify that the individual has appropriate authority before taking action.

8. File a Complaint

You may complain if you believe your privacy rights have been violated.

Pharmedico will not retaliate against you for filing a privacy complaint.

YOUR CHOICES

For certain health information, you may tell us your preferences about what information we disclose.

Family Members, Friends, and Others Involved in Your Care

You may tell us whether we may share relevant information with a family member, friend, caregiver, or other person involved in your care or payment for your care.

If you are unable to tell us your preference—for example, because of incapacity or an emergency—we may disclose limited information when permitted by law and when we believe the disclosure is in your best interest.

We may also disclose information when necessary to prevent or reduce a serious and imminent threat to health or safety, as permitted by law.

Disaster Relief

We may disclose appropriate information to organizations assisting with disaster-relief efforts when permitted by law.

Marketing

We will obtain your written authorization before using or disclosing PHI for marketing when HIPAA requires authorization.

Ordinary communications concerning your treatment, medication, health-related products or services, refill information, or other communications permitted by HIPAA may not require a marketing authorization.

Sale of PHI

Pharmedico does not sell your Protected Health Information.

We will not sell PHI in circumstances requiring HIPAA authorization without first obtaining the authorization required by law.

Psychotherapy Notes

Pharmedico generally does not create psychotherapy notes.

If Pharmedico receives psychotherapy notes, most uses or disclosures requiring authorization will not occur without the appropriate written authorization.

Fundraising

Pharmedico does not currently use PHI for fundraising activities.

HOW WE TYPICALLY USE OR DISCLOSE YOUR HEALTH INFORMATION

Treatment

We may use and disclose your health information to provide, coordinate, or manage your healthcare.

For example, a Pharmedico pharmacist may communicate with:

Your prescribing physician
Nurse practitioner
Physician assistant
Veterinarian where applicable
Another pharmacy
Another pharmacist
Another healthcare professional involved in your care

This may include discussing medication selection, dosage, formulation, allergies, interactions, refill authorization, compounding requirements, or other information necessary to safely provide pharmacy services.

Healthcare Operations

We may use and disclose your health information to operate our pharmacy and improve the services we provide.

Examples include:

Quality assurance
Medication safety
Staff training
Compliance activities
Auditing
Credentialing
Business management
Customer service
Evaluating pharmacy operations
Fraud and abuse prevention

Payment

We may use and disclose health information as necessary to receive payment for services or products.

Pharmedico may also provide information needed for:

Patient billing
Payment reconciliation
Reimbursement documentation requested by a patient
Payment-related inquiries
Coordination with another legally authorized payer when applicable

OTHER USES AND DISCLOSURES PERMITTED OR REQUIRED BY LAW

HIPAA and other laws allow or require us to use or disclose health information in certain circumstances.

Public Health and Safety

We may disclose health information for authorized public-health and safety activities, including:

Preventing or controlling disease
Reporting certain diseases or conditions
Reporting adverse reactions to medications
Product recalls
Medication safety activities
Reporting suspected abuse, neglect, or domestic violence when authorized or required by law
Preventing or reducing a serious threat to health or safety

Health Oversight

We may disclose health information to health oversight agencies for legally authorized activities such as:

Pharmacy inspections
Audits
Investigations
Licensing activities
Regulatory compliance

This may include disclosures to agencies with oversight authority over pharmacies, pharmacists, controlled substances, or healthcare operations.

Compliance With Law

We will disclose health information when federal or state law requires us to do so.

This may include disclosures to government agencies responsible for enforcing healthcare privacy, pharmacy, controlled-substance, public-health, or other applicable laws.

Prescription Monitoring and Controlled Substances

When required or permitted by law, Pharmedico may report or obtain information relating to controlled substances through applicable prescription drug monitoring programs and other authorized governmental systems.

Research

We may use or disclose health information for health research only when permitted by applicable law and when required HIPAA safeguards, approvals, authorizations, or waivers are in place.

Organ and Tissue Donation

When applicable, we may disclose health information to organizations involved in organ, eye, or tissue donation and transplantation as permitted by law.

Coroners, Medical Examiners, and Funeral Directors

We may disclose health information to a coroner, medical examiner, or funeral director when permitted or required by law.

Workers' Compensation

We may disclose health information as authorized or required by workers' compensation laws or similar programs.

Law Enforcement

We may disclose health information to law-enforcement officials when permitted or required by law and when applicable legal requirements have been satisfied.

Government Functions

We may disclose information for authorized governmental functions such as military activities, national security, protective services, correctional institutions, or other purposes permitted by law.

Lawsuits and Legal Proceedings

We may disclose health information in response to a lawful court or administrative order.

We may also respond to subpoenas, discovery requests, or other lawful processes when the requirements of HIPAA and other applicable laws have been satisfied.

SUBSTANCE USE DISORDER RECORDS

Certain records relating to substance use disorder treatment may receive additional protections under federal law, including 42 CFR Part 2.

To the extent Pharmedico receives or maintains records protected by 42 CFR Part 2, additional restrictions may apply.

Information from records protected by Part 2 generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you unless permitted by applicable federal law, such as with your written consent or an appropriate court order and subpoena.

Pharmedico will handle Part 2 information in accordance with applicable federal requirements.

USES AND DISCLOSURES REQUIRING YOUR AUTHORIZATION

Uses and disclosures of PHI not otherwise permitted or required by law generally will be made only with your written authorization.

If you provide authorization, you may revoke it in writing at any time.

Revocation will not affect actions already taken in reliance on your authorization before the revocation was received.

ELECTRONIC COMMUNICATIONS

Pharmedico may communicate with you electronically when appropriate and permitted by law.

Electronic communication methods can have privacy and security risks.

When health information is involved, we take reasonable safeguards appropriate to the communication and applicable law.

You may request that we communicate with you using a different reasonable method or at a different location.

OUR RESPONSIBILITIES

Pharmedico is required by law to:

Maintain the privacy and security of your Protected Health Information
Follow the privacy practices described in this Notice while it is in effect
Provide you with a copy of this Notice
Notify affected individuals as required by law if a breach occurs that may have compromised the privacy or security of unsecured PHI
Use or disclose only the information appropriate for the permitted purpose when applicable
Obtain your written authorization for uses and disclosures requiring authorization

We will not use or disclose your information other than as described in this Notice unless you authorize us to do so in writing or the use or disclosure is otherwise permitted or required by law.

MORE PROTECTIVE LAWS

Certain federal or state laws may provide health information with protections greater than those provided by HIPAA.

When another applicable law imposes stricter privacy protections or disclosure restrictions, Pharmedico will comply with the more protective requirement where required.

CHANGES TO THIS NOTICE

We may change the terms of this Notice and our privacy practices.

Changes may apply to all PHI we maintain, including information created or received before the change.
